1. Introduction
This online store (hereinafter referred to as the “The Web Shop”) is operated by Thomas Anderberg and Ola Berg and The Rebel Saints (hereinafter referred to as “The seller”).
The terms of purchase apply to contracts for the purchase of goods concluded between the Seller and the consumer or trader who completes the order (hereinafter referred to as the “Customer”) through the Web shop. The Seller and the Customer are collectively referred to below as “Parties” and separately as “Party”.
The terms of purchase are valid from the day the Customer accepts them and until the delivery has been completed and the Seller has received the payment. However, the provisions of the Terms of Purchase relating to dispute settlement, intellectual property rights and any other provisions which, expressly or in view of its nature, are intended to apply even after the termination or completion of the purchase agreement shall continue to apply after its termination or completion.
In the event that the Customer is a consumer, in addition to the Terms of Purchase, applicable Swedish consumer protection legislation, such as the Act on Distance Contracts and Off-Premises Contracts (2005:59) (“Distance Contracts Act”) and the Consumer Purchase Act (2022:260), applies. These Terms of Purchase shall not apply to the extent that they limit the consumer’s rights under mandatory law.
2. Definitions
In addition to the terms defined in series in these Terms of Purchase, the following definitions shall have the following meaning when expressed in capital letters as initial letters, whether used in plural or singular, in definite or indefinite form:
Payment service provider: refers to a Third party who processes, among other things, payments from Customers on behalf of the Seller.
GDPR: refers to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
Third party: refers to someone other than the Customer or the Seller.
Product page: refers to a page in the Web Shop that refers to a Good, with information about, for example, the price, materials, available sizes, etc.
Goods: refers to the goods sold at any time by the Seller via the Web Shop.
3. Purchase
Age limit: You need to have the right to enter into a contract in accordance with applicable law in order to make a purchase through the Web shop. This means that you must be at least 16 years old to trade with direct payment for your own money, or at least 18 years of age to trade on credit. If you are younger than 18 years of age, you must also have your guardian’s consent to make purchases through the Web Shop. By completing the purchase, you represent that you are entitled to enter into the sales agreement with the Seller.
Signatories: The individual who completes the purchase in its capacity as authorised signatory for the trader, legal person or organisation represented hereby certifies that it is entitled to enter into the purchase agreement with the Seller and that these Terms of Purchase become binding between the Parties.
Commitment: By completing the purchase, the Customer declares that the Customer has read and accepts the Terms of Purchase, and that the Customer undertakes the obligation to comply with them.
Electronic communication: The Customer agrees that the Seller transmits information, documentation and documents relating to the purchase by e-mail or other form of electronic communication to the Customer’s specified contact details.
Information: The Customer is responsible for recording correct information in connection with the purchase, such as Customer details, contact details and delivery address.
Binding agreements: When the Customer sends an order to the Seller by clicking on “Pay”, “Pay purchase” or similar at checkout, the Customer undertakes an obligation to pay for the Goods specified in the order. A binding purchase agreement between the Parties is concluded only after the Seller has confirmed the order by means of an order confirmation sent to the e-mail address provided by the Customer in connection with the purchase.
Order Confirmation: In the order confirmation, the Customer will find all information about the purchased Goods, price, billing and delivery address. If the Customer discovers any error in the order confirmation, the Customer must immediately contact the Seller by e-mail: contact@rebelsaints.se. If the Customer has not received an order confirmation after completing the order, the Customer should first check the spam folder and then contact the Seller if necessary. In the event of any inaccuracies in, for example, the indication of price, delivery time, etc., the Seller reserves the right to rectify this afterwards.
Performance of the contract: The Customer has completed its part of the purchase contract when the Customer has paid in full payment for the order. The Seller has completed its part of the purchase contract when the full delivery of the purchased Goods has been completed.
Photos: The Seller does not guarantee that the images reflect the exact appearance of the Goods, as a certain colour difference between image and reality may occur depending on the display, photo quality and resolution. However, the Seller always tries in the best way to expose the Goods as accurately as possible.
Open purchase or exchange right: The Seller does not apply any open purchase or exchange right.
Custom-made Goods: If the Goods are specially manufactured in accordance with the Customer’s order, the order cannot be cancelled or withdrawn.
4. Prices and discounts
Price: The Seller has the right to change the prices published in the Web Shop at any time. The price stated in connection with the order is the price that applies to the purchase.
Reservations: All offers are valid as long as stocks last. There may be unavailable and sold-out Goods in the Web shop. If a particular Goods ordered by the Customer is not in stock, the Seller will contact the Customer. The Seller will also refund the Customer for any payment made by the Customer in respect of such Goods. The Seller also reserves the right to correct any misprint in the price list as well as errors in prices due to incorrect information and reserves the right to adjust the price and any factual errors that may be found on the Web Shop or in the Seller’s advertisements.
Discounts: Discounts cannot be redeemed for cash or be combined with other offers, unless expressly stated otherwise. Discount offers are valid for a limited period of time. Any discount code can only be used if it is stated within the period of validity and prior to the completion of the order. Furthermore, it is only possible to use the discount code one (1) time per time of order, unless otherwise expressly stated.
Promotions: Offers and promotions marketed in the Web Shop are valid as long as stock lasts if no other conditions are stated in connection with the offer. Any special promotional terms and conditions apply only for the duration of the promotion. The provisions of this clause apply unless otherwise expressly stated in connection with the promotion.
5. Delivery
Delivery time to:
— SWEDEN: 2-14 days
— EUROPE: 3-20 days
— THE REST OF THE WORLD: 5-25 days
NOTE! Some Goods have special delivery time, please check individual Product page for info.
Should delays in delivery occur (without the Seller having notified the Customer of a longer delivery time), the Customer must contact the Seller’s Customer Service Department by e-mail: contact@rebelsaints.se. However, a complaint due to delay does not imply an automatic cancellation of the purchase agreement. The Seller has the right to rectify the delay and complete the purchase within a reasonable time after the complaint has been received. If it is not possible to complete the delivery, the Goods in question will be cancelled and the Customer will receive the amount paid back by the Customer for the Good in question.
The shipping is calculated on the basis of the weight of the order.
Unredeemed packages
Unredeemed packages will be returned to the Seller. For all packages that are not redeemed, the Seller reserves the right to charge the Customer for return shipping and handling fees.
Payment
Payment can be made through the payment methods available at any given time offered through the Web Shop by the integrated Payment Service Providers.
The Customer is hereby informed that the Customer accepts the Payment Service Provider’s terms and conditions and the processing of personal data provided by the Customer in connection with the purchase, when the Customer makes a payment through the Payment Service Provider’s payment service. The Customer is responsible for reading the Payment Service Provider’s terms and conditions before making the purchase.
The Rebel Saints accepts payments with PayPal.
Returns
— If the Customer is to return Goods to the Seller, the Customer must first contact the Seller by email contact@therebelsaints.se. The Customer will then receive an return address, which must be written on the outside of the package, so that the Seller can handle the case in the best possible way.
— The Customer chooses a suitable way to return the Goods to the Seller, e.g., in a cardboard box, padded envelope or bag. Please note that if the Customer’s shipment is lost or damaged by the carrier the Customer chooses to ship with, the Seller will not replace this. If the Goods have a high value, it may be advisable to send as a traceable registered letter or similar, so that the Customer has the opportunity to complain about his lost/damaged shipment to the carrier. The carrier in these cases can be e.g., PostNord, DHL and similar.
7. Right of withdrawal (applies only on vinyl LP’s and/or CD’s and for Swedish customers)
Customer as a consumer may have the right to cancel its purchase (right of withdrawal) carried out on distance, under the Distance Contracts Act. The right of withdrawal means that the consumer has the right to withdraw from the purchase agreement within the withdrawal period without giving any reason, provided that the conditions for the right of withdrawal are met. The withdrawal period is 14 days and starts the day after the consumer has received the Goods. The right of withdrawal applies only to consumers (non-traders).
Important! The Distance Contracts Act does only apply for Swedish customers and on vinyl LP’s and/or CD’s. The Distance Contracts Act does not apply on any of the merchandize goods.
The consumer has the right to open the package to investigate the Goods, in order to determine its features and characteristics, but if a decrease in value has occurred because the Consumer has handled the Goods to a greater extent than was necessary to determine its characteristics or function, the consumer shall reimburse the Seller for the loss in value.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to contracts relating to a Good that has been manufactured in accordance with the consumer’s instructions or which has otherwise received a clear personal character (“Specially Manufactured Goods”) (pursuant to Chapter 2, Section 11, point 3 of the Distance Contracts Act).
This means that there is no right of withdrawal for goods that are specially manufactured when ordering according to the Customer’s specified dimensions and any other wishes, such as color, print, shape, etc.
The right of withdrawal does not apply on vinyls and CD’s with a plastic cover/seal that has been opened.
The right to return Specially Manufactured Goods only applies to defective Goods.
Invoking the right of withdrawal
If the Customer wishes to exercise his right of withdrawal, the Seller shall be informed by e-mail to contact@rebelsaints.se. In the Customer’s message, the Customer’s name, address, e-mail address, order number and which Goods to which the return relates must be clearly stated.
If the Customer chooses to exercise its right of withdrawal and has the right of withdrawal, the Good shall be returned to the Seller no later than 14 days from the date on which the Customer has notified the Seller that the Customer wishes to exercise his right of withdrawal. The Customer is responsible for return shipping. Goods must be returned in original packaging and well packaged to reduce the risk of damage during transport.
The Seller will make a refund within 14 days of the date on which the Seller received the Customer’s notification that the right of withdrawal is being exercised, provided that the Seller has also received the Goods in return or the Customer has proved to the Seller that the Good has been returned.
Upon the Customer’s return of a used or damaged Goods, the Seller reserves the right to deduct an amount corresponding to the decrease in value compared to the original value of the Good from the refund amount.
The Seller will refund the amount paid for the Goods, minus any impairments that have occurred due to the Customer’s handling of the returned Goods, shipping costs and other overheads.
The payment method for the refund is the same as that used by the Customer at the time of purchase unless the Parties expressly agree otherwise.
Complaints
Should the Goods be damaged or incorrectly shipped when it arrives to the Customer, the Seller undertakes to remedy the defect free of charge.
If it is found that the Goods in question is not incorrect in accordance with applicable law, the complaint will not be accepted.
Any freight damage must be complained to the carrier/shipping company.
The Customer must always contact the Seller for an approval before the Customer returns any Goods and shall provide the Customer’s name, address, e-mail address, order number and description of the defect in the complaint.
The complaint must be sent within a reasonable time after the Customer has noticed or should have noticed the fault.
The Customer as a trader has a right of complaint for two (2) months.
Customer as a consumer has a right of complaint for three (3) years under the law. Notice of reliance on defects by complaint made within two (2) months after the consumer has noticed the defect is deemed to have been made in due time.
The Seller is responsible for return shipping for approved complaints. The Seller will also pay for the shipping if the Customer wishes a new item as compensation.
9. Penalties for defects in the goods
The Customer, as a consumer, is entitled to the following measures if the Goods are defective: require remedial, re-delivery, price reduction or compensation to remedy the defect or cancel the purchase. In addition, the consumer may claim damages. The consumer may also withhold payment. The Customer as a trader is only entitled to demand that the defect be rectified.
Remedial
The Seller is obliged to remedy the defect or make a re-delivery only if the action is possible and can be taken at no unreasonable cost to the Seller.
Rectification or re-delivery shall be made within a reasonable time after the Customer made his claim and free of charge or material inconvenience to the Customer. Although the Customer requires a penalty other than remedial or re-delivery, the Seller is entitled to take such action, if this can be done under the conditions set out in the preceding sentence.
In the event of re-delivery, the Seller shall at his own expense withdraw the defective goods. The Customer shall make the Goods available to the Seller in the event of rectification and re-delivery. In case of re-delivery, however, this does not need to be done until a new item is delivered.
10. Delayed or missing delivery
In rare cases, the delivery time from the time the Seller has sent an order may be long, up to 6 weeks. Such delays are entirely beyond the Seller’s control and the Seller cannot be held liable for these. In rare cases, packages can even disappear completely.
The Seller’s policy is to wait 4 weeks before we can consider that a shipment is missing. Only after 6 weeks from the date the Seller has sent an order can the Seller make a refund or send the order again.
If the Customer has provided an incorrect address at the time of the order and the shipment for this reason does not arrive at the Customer, the Seller is not obliged to refund the Customer or re-ship the order.
Personal data
The Seller processes all personal data in accordance with GDPR. Read more about the Seller’s processing of personal data in the Seller’s privacy notice at the following link: Privacy Notice.
Limitation of liability
The Seller is exempt from penalty for failure to perform certain obligations in this contract if the failure is due to liberating circumstances as set out below and the circumstance hinders, prevents, or delays performance. A liberating circumstance shall be considered to be, among other things, an act or omission by a public authority, new or amended legislation, conflict in the labour market, blockade, strike, fire or flood, sabotage or major accident. Force majeure also includes decisions by authorities that affect the market and Goods negatively, e.g. restrictions, warnings, sales bans, etc.
The Seller disclaims all liability to the extent permitted by applicable law. However, this limitation of liability does not limit the Seller’s liability to a greater extent than permitted by applicable legislation.
Other provisions
There may be typographical errors and changes to technical data beyond the Seller’s control and the Seller reserves the right to cancel orders that have become faulty due to technical errors.
If any provision of the Terms of Purchase is found in whole or in part to be unenforceable or invalid by a general court, arbitration panel or the National Board for Consumer Disputes (ARN), it shall not invalidate the terms and conditions in their entirety. Instead, the relevant provision in other parts and all other provisions of the purchase agreement shall be in force, and the Seller shall make the necessary changes to the terms in order to maintain the purpose, structure, and spirit of the contract of sale.
The latest version of the Terms of Purchase is published in the Web shop. The Seller has the right to update and amend the Terms of Purchase at any time. For example, this may be done to clarify the content, when offering new Goods or if it is necessary due to legislative changes, regulatory decisions, regulations or if it is required for technical, operational or safety reasons. Any changes will take effect when they have been published in the Web shop and do not need to be notified in advance. The amended Terms do not apply to orders placed before the amended terms have been published in the Web shop.

11. Applicable law and dispute resolution
Applicable law: The purchase agreement including the Terms of Purchase shall be interpreted and applied in accordance with Swedish law and law.
Alternative dispute resolution method: Disputes arising between a Customer as a consumer and the Seller shall primarily seek to be resolved between the Parties. The consumer always has the right to contact the National Board for Consumer Disputes (ARN) (www.arn.se, postal address: Allmänna Reklamationsnämnden Box 174, 101 23 Stockholm), which offers an alternative dispute resolution for consumer disputes.
The consumer also has the right to contact the Consumer Ombudsman (Ko.se).
For consumers living in an EU country other than Sweden, you can file a complaint online via the European Commission’s digital platform for mediation in disputes, see http://ec.europa.eu/consumers/odr.
If the Seller and the Consumer do not reach a settlement of the dispute through any alternative dispute resolution method, the dispute may be heard and finally settled by the ordinary courts of Sweden, unless otherwise required by mandatory law.
General Court: If the Customer is a trader, the dispute with the Seller shall be finally settled by the ordinary court in Sweden with the District Court in Stockholm as the first instance.
